1. About these terms

These terms apply to work carried out by Tony The Property Services Limited, based in Glasgow, Scotland, UK. They form part of the contract between us alongside the written quote we issue for your job. Where the quote and these terms differ, the quote takes precedence.

2. Quotes

  • Quotes are free, issued in writing, and valid for 30 days unless stated otherwise.
  • A quote covers only the work described on it. Work not described is not included, even where it may seem implied.
  • Quotes prepared from photographs or a description rather than a site visit are given in good faith on the information supplied. If conditions on site differ materially, we will tell you before starting and reissue the price.
  • A quote becomes binding on both parties when you accept it in writing.

3. Variations and unforeseen work

Property work occasionally uncovers something that could not reasonably have been seen beforehand — failed plaster behind wallpaper, a wall that will not take a fixing, or damp behind a unit. Where that happens:

  • Work on the affected area stops.
  • We show you what has been found and explain the options.
  • You receive a written price for the additional work, and nothing further is carried out until you approve it.

The same applies to changes you request. No additional charge is ever incurred without your prior agreement.

4. Access and site conditions

  • You agree to provide safe access to the property at the agreed times, and access to mains power and water where the work requires it.
  • Please move or clear anything specified in the quote before we arrive. Where you would like us to move furniture, we are usually happy to, but ask that fragile and valuable items are removed by you beforehand.
  • Where we cannot gain access at an agreed appointment, a charge may be made to cover reserved time.

5. Materials

  • Where we supply materials these are itemised on the quote. Title in materials passes to you on payment in full.
  • Where you supply materials, we cannot accept responsibility for their suitability, quality or sufficiency, though we will always advise if we think there is a problem before using them.
  • Colour and finish may vary between batches and can look different under the lighting in your property compared to a sample.

6. Payment

  • Payment terms for your job are set out on the quote and repeated on the invoice.
  • Unless agreed otherwise in writing, invoices are payable within 14 days of the invoice date.
  • Larger jobs may require a deposit towards materials, with the balance due on completion.
  • We may charge statutory interest on overdue commercial invoices under the Late Payment of Commercial Debts (Interest) Act 1998.

7. Completion and putting things right

We walk the completed work with you before invoicing. If any part of it falls short of what was quoted, tell us and we will return and put it right at no charge. Please raise any concerns as soon as you notice them.

Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015, which require services to be carried out with reasonable care and skill.

8. Cancellation

Where you are a consumer and the contract was agreed away from our business premises — which includes most agreements reached at your property, by phone or online — you have the right to cancel within 14 days of accepting the quote, without giving a reason.

  • To cancel, tell us in writing at info@tonythepropertyservices.com within that period.
  • If you asked us to begin work during the cancellation period, you remain liable for the value of work carried out up to the point of cancellation.
  • Where work has been fully performed during the cancellation period at your express request, the right to cancel is lost.

If we need to cancel or reschedule — through illness, weather affecting external work, or a materials delay — we will give you as much notice as possible and refund any deposit for work not carried out.

9. Liability

We take reasonable care to protect your property, including covering floors, furniture and fittings in the work area. We are responsible for loss or damage caused by our failure to use reasonable care and skill.

We are not liable for loss or damage that was not foreseeable, for pre-existing defects that our work has revealed rather than caused, or for business losses where you are using our services for commercial purposes. Nothing here limits our liability for death or personal injury caused by negligence, or for fraud.

10. Complaints

If something is not right, contact us at info@tonythepropertyservices.com or on 07778 728111. We aim to acknowledge complaints within two working days and resolve them within 14 days.

11. Governing law

These terms are governed by the law of Scotland and are subject to the exclusive jurisdiction of the Scottish courts.
